Can I claim workers compensation in NSW?

If you are a worker who has suffered an injury or illness that is work-related you may be able to claim workers compensation in NSW. This can include injuries that happen at work, while carrying out work duties, or in some circumstances, while travelling for work. Workers compensation is generally available regardless of who was at fault, as long as the injury or illness is work related.

What benefits can I claim under workers compensation?

Workers compensation benefits include weekly payments for loss of income, medical and treatment expenses, rehabilitation support, and lump sum compensation for permanent impairment where eligibility requirements are met. The benefits available depend on the nature and severity of your injury.

Can workers compensation pay for medical treatment?

Yes, workers compensation may cover reasonably necessary medical, hospital, and rehabilitation expenses related to a workplace injury. This can include treatment such as consultations, medication, physiotherapy, and other approved services. The treatment must be required as a result of the injury and meet the relevant requirements under the workers compensation scheme.

Can I claim workers compensation for psychological injury?

Yes, you may be able to claim workers compensation for a psychological or psychiatric injury if it is work-related. This can include injuries caused by workplace incidents, trauma, bullying, harassment, excessive workload, or other employment-related factors.

From 1 July 2026, changes to NSW workers compensation laws will introduce stricter requirements for some primary psychological injury claims, including higher impairment thresholds that may affect access to certain benefits and work injury damages claims. Seeking legal advice early can help you understand your rights and whether you may be eligible to make a claim.

What should I do after a workplace injury?

After a workplace injury, you should report the injury to your employer as soon as possible, seek appropriate medical treatment, keep records of your symptoms and expenses, and make a workers compensation claim where appropriate. Obtaining advice early can help ensure your rights and entitlements are protected.

Do I need a workers compensation lawyer?

Legal advice can be helpful if your claim is disputed, your injury is serious, or you are unsure about your entitlements. Our lawyers are IRO (Independent Review Office) approved, and eligible injured workers may be able to access funding through the IRO’s Independent Legal Assistance and Review Service (ILARS) to assist with legal costs. We can help you understand your rights and guide you through the workers compensation process.
