LawAdvice negotiates a settlement in favour of client injured in skiing incident

Our client was enjoying a skiing holiday in the Snowy Mountains when she was struck by an employee of the snowfields causing her to fall heavily on the ground. She sought advice from LawAdvice Compensation Lawyers in relation to a public liability claim. Our lawyers reviewed her matter and concluded that a claim could be made pursuant to the Civil Liability Act 2002. Documents and medical evidence were immediately gathered in preparation of the claim.

 

Our client suffered serious injuries including a fractured shoulder, injury to her spine, injury to her right wrist and a psychiatric injury. These injuries had a knock-on effect on her life. She was unable to return to hobbies such as skiing, playing netball and playing tennis. Further, she required treatment in the form of surgery, physiotherapy and specialist consultation.

 

Unfortunately, at the time of the accident, our client had embarked on a brand-new business venture and was in the start-up process of that business. A claim was made for the loss of business opportunity due to her injuries and disabilities. Further claims were made for pain and suffering, treatment expenses and domestic assistance.

 

We gathered all the necessary evidence in order to prove our client’s losses in court. The matter was filed in the District Court of New South Wales where it entered a court timetable and was ultimately listed for hearing. Before the hearing date, both parties sat down for a settlement to see whether an agreement could be reached. After lengthy negotiations, a settlement figure was agreed to and the matter resolved without the need to proceed to a court hearing. Our client was very happy for her public liability matter to be resolved for an outcome in her favour.
